During the initial week of the school year last fall, a female student was allegedly raped in her dorm room by a diver from the University of Utah who has since been arrested and charged.
Ben Smyth, a Canadian diver who is currently in his second year at Utah, has been accused by prosecutors of committing sodomy, sexual abuse, and rape.
According to an indictment submitted this week, detectives allege that Smyth visited a female dormitory room in August of last year after verifying that she was by herself.
According to reports, he requested her to participate in a game of "truth or dare" and supposedly sexually assaulted her despite her physical resistance, verbal refusal, and indication of discomfort.
Initially, when questioned by detectives, he denied being acquainted with the woman. However, he later admitted to engaging in sexual activity with her and acknowledged that she was experiencing discomfort.
The accusation, which does not identify the female, further states that when investigators attempted to deliver a restraining order to Smyth to prevent him from contacting the woman, a housemate informed them that he had vacated the premises.
A detective was informed by a private investigator that Smyth had gone back to Canada after discovering that he was being investigated for rape.
According to court records, detectives state that Smyth's acquaintances reported him boasting about the quantity of women he had sexual relations with. He even created a list to exhibit to others.
A friend of a children's book author from Utah claimed that she had a flawless marriage with her husband before he allegedly murdered her. The University of Utah's athletic department announced that Smyth was removed from the men's swimming and diving team after the school was informed of the accusations in February, prior to the Pac-12 Championships. Although Smyth did not participate in the competition this year, they secured the second position in platform diving during their first year as a student.

As soon as the University's Office of Equal Opportunity informed the department about an ongoing investigation, Ben Smyth was promptly suspended.
Earlier this week, Sim Gill, the District Attorney of Salt Lake County, stated that his office was exploring all options to bring Smyth back to Utah after a warrant was issued for his arrest.
On Friday, his workplace announced that Smyth had come back to the United States.
They refused to disclose if he was under arrest.
The apprehension of the diver is not the first instance where Pac-12 swimming and diving has dealt with accusations of rape in the past few years.
Brock Turner, a swimmer from Stanford University, was convicted of sexually assaulting a woman in 2016. He was caught by two graduate students while he was on top of an unconscious woman behind a dumpster on the campus.
The charges were not commented on by Smyth's lawyer, Scott Wilding.
